What does Terrorism Insurance Cover on your Insurance Policy?

Since congress enacted the Terrorism Risk Insurance Act or TRIA in November of 2002,  there has NEVER been a claim covered under TRIA because the government has failed to “certify” them as a "Certified Act of Terrorism".


The following is a sample of how the government Terrorism Insurance form reads:

This means that the Terrorism Risk Insurance Act Coverage that applied to policy holders involved in Boston Marathon bombing, as well as recent incidents in New York City, New Jersey, San Bernardino, California; Charleston, South Carolina and Chattanooga, Tennessee, have not paid out anything to policyholders.

The current Terrorism Insurance, or TRIA program has cost the government approximately $1M a year but at the pime of this posting, has made an estimated $40B for insurance companies since it's inception.

Congress has failed to take any action to change this practice, thus leaving Terrorism Insurance policy holders paying for insurance that won’t pay out even if there is a terrorist attack.


What does “a Certified Act of Terrorism” mean ?

Policyholders can only claim through their current TRIA coverage if the act is deemed to be “certified”. This “certification” comes from a decision by the Secretary of State, the Secretary of the Treasury, and the Attorney General of the United States. They need to determine that the act meets all the following criteria:

• It is considered an act of terrorism.
• It is violent or dangerous to human life, property, or infrastructure.
• It results in damage within the United States, (including US air carriers, vessels, and/or US missions, as described in the Act).
• It is committed by an individual or individuals, as part of an effort to coerce the US civilian population or to influence the policy or affect the conduct of the US government by coercion.
